1.0 PREFACE
On behalf of the Committee on Appointments and pursuant to the provisions of Standing Order 185, it is my pleasure and duty to present to the Assembly the Committee Report on the Vetting of the Nominees for the positions of the County Executive Committee Members in charge of –
- Trade, Industrialization, Cooperative Development, Tourism and Wildlife,
- ICT, Culture and Social Services, and
- Lands, Energy, Housing, Physical Planning and Urban Development.

1.2 COMMITTEE MANDATE
The Committee on Appointments is one of the Select Committees established under Standing Order 185 (4) which provides that; the Committee on Appointments shall consider, for approval by the County Assembly, appointments under Articles 179 (2) (Members of County Executive Committees).
1.3 COMMITTEE MEETINGS
The Committee held three (3) meetings at the County Assembly Committee Room during which the said nominees were vetted in accordance with the Kilifi County Vetting and Appointments of Public Officers (County Assembly Approval) Act, 2016 on the dates indicated below – Ms. Zeyanna Abdullah, the nominee for position of County Executive Committee Member for Trade, Industrialization, Cooperative Development, Tourism and Wildlife withdrew from the approval process vide an email notice dated 6th October, 2016 indicating that she had already taken a rewarding position in another organization.

Pursuant to Article 179 (2) of the Kenya Constitution 2010, H.E the Governor through the County Secretary and Head of Public Service forwarded to the Clerk of the Assembly, the names of the following Three (3) nominees vide a letters dated 19th September, 2016 and 4th October, 2016 for vetting by the Committee on Appointments and consideration for approval by the County Assembly for appointment as County Executive Committee Members;

Pursuant to Article 196 (1) (b) of the Constitution of Kenya, 2010; the Committee invited interested members of the public through advertisement in the national and local dailies to submit their representations/ Memoranda or Petition they may have on the nominees to the Clerk of the County Assembly of Kilifi. Pursuant to Section 8 (1) (a) and 35 of the County Government Act, 2012; Section 8 of the Kilifi County Vetting and Appointment of Public Officers (County Assembly Approval) Act, 2016 and Standing Order 43 of the County Assembly of Kilifi Standing Orders, the nominees were invited to appear before the Committee on Appointments on 13th and 27th October 2016 at the County Assembly Committee Room as indicated below. Members of the public were also invited to attend the vetting Session.

3.0 CRITERIA FOR VETTING
Section 9 of the Kilifi County Vetting and Appointments of Public Officers (County Assembly Approval) Act, 2016 provides that the issues for consideration by the County Assembly in relation to any nomination shall be:-
- The procedure used to arrive at the nominee;
- Any constitutional or statutory requirements relating to the office in question; and
- The suitability of the nominee for appointment proposed having regard to whether the nominee’s abilities, experience and qualities meet the needs of the body to which nomination is being made.
Further, section (8) of the Kilifi County Vetting and Appointments of Public Officers (County Assembly Approval) Act, 2016 provides that a candidate may at any time, by notice in writing addressed to the Clerk withdraw from the approval process.
4.0 SUBMISSION OF MEMORANDA
Pursuant to section 8 of the Kilifi County Vetting and Appointments of Public Officers (County Assembly Approval) Act, 2016, (hereinafter referred to as “the Act”), which provides that “any person may, prior to the approval hearing, and by written statement on oath, provide the Clerk with evidence contesting the suitability of a candidate to hold the office to which the candidate has been nominated”, the Clerk Of the County Assembly placed two adverts in the local dailies on Friday 30th September, 2016 and 18th October, 2016, inviting interested members of the public to submit any representations by written statement on oath (affidavit), that they may have on the suitability of the said nominees for appointment as County Executive Committee Members.
The Committee received two memoranda from Kilifi County Alliance and Kilifi Professionals Association on the suitability of Mr. Charles Dadu Karisa.

Ms. Zeyana Abdullah, the nominee for position of County Executive Committee Member for Trade, Industrialization, Cooperative Development, Tourism and Wildlife withdrew from the approval process vide an email notice dated 6th October, 2016 indicating that she had already taken a rewarding position in another organization.

5.2.1 COMMITTEE FINDINGS
After conducting the Vetting Exercise, the committee made the following findings –
- That, the nominee doesn’t meet the requirements of Section 35 (3) (d) of the County Government Act, 2012 and Section 9 (c) of the Kilifi County Vetting and Appointment of Public Officers (County Assembly Approval) Act, 2016.
- That, Mr. Joseph Elvis Tinga Janga was unable to articulate topical issues in the line department very professionally and showed no technical capabilities in ICT, Culture and Social Services.
- That, the Committee found the nominee unsuitable for the position nominated for.
5.2.2 RECOMMENDATION OF THE COMMITTEE
At the end of the vetting process, the Committee made the following recommendations: –
That, having considered the suitability, capacity and integrity of the nominee, and pursuant to Section 35 (3) (d) of the County Government Act, 2012, County Assembly Standing Order No. 43 and the Kilifi County Vetting and Approval of Public Officers (County Assembly Approval) Act, 2016, the Committee recommends that the County Assembly of Kilifi REJECTS the Nomination and subsequent Appointment of Mr. Joseph Elvis Tinga Janga as the County Executive Member in charge of ICT, Culture and Social Services.
- CHARLES DADU KARISA – NOMINEE; COUNTY EXECUTIVE COMMITTEE MEMBER IN CHARGE OF LANDS, ENERGY, HOUSING, PHYSICAL PLANNING AND URBAN DEVELOPMENT
Mr. Charles Dadu Karisa, the Nominee for the position of County Executive Committee Member in charge of Lands, Energy, Housing, Physical Planning and Urban Development appeared before the Committee on Thursday, 27th October, 2016 at 10.00 a.m and was orally interviewed under Oath pursuant to the provisions of the Constitution of Kenya, 2010; the Kilifi County Vetting and Appointment of Public Officers (County Assembly Approval) Act, 2016 and the Standing Orders of the County Assembly of Kilifi.

5.3.1 COMMITTEE FINDINGS
The Committee having considered the Curriculum vitae and heard his oral submissions during the vetting exercise/approval hearing, made the following findings –
- That, the nominee meets the requirements of Section 35 (3) of the County Government Act, 2012 and Section 9 of the Kilifi County Vetting and Appointment of Public Officers (County Assembly Approval) Act, 2016.
- That, the nominee holds clearance certificates from the Ethics and Anti-Corruption Commission, Credit Reference Bureau, Higher Education Loans Board, Kenya Revenue Authority and the Criminal Investigation Department.
- That, the nominee has participated in various pro-bono/charity undertakings
- That, the nominee has never been charged in a court of law and is tax compliant.
- That, the Nominee was likely to have client base conflict of interest but he submitted that he would resolve any potential conflict of interest through communication to his clientele on his new office and its implications in his practice. He would also refer potential clients to the register of various professionals relevant to the need at hand.
- That, the nominee has never been dismissed from office for contravention of the provisions of Chapter six of the Constitution of Kenya, 2010 which deals with conduct of state and public officers.
- That, the memoranda received on his suitability recommended the nominee for the position he was nominated for.
- The Committee found the nominee suitable for appointment as the County Executive Committee Member in charge of Lands, Energy, Housing, Physical Planning and Urban Development.
5.3.2 RECOMMENDATIONS OF THE COMMITTEE
At the end of the vetting process, the Committee made the following recommendations:-
That, having considered the suitability, capacity and integrity of the nominee, and pursuant to Section 35 of the County Government Act, 2012, County Assembly Standing Order No. 43 and section 9 of the Kilifi County Vetting and Approval of Public Officers (County Assembly Approval) Act, 2016, the Committee recommends that the County Assembly of Kilifi APPROVES the Nomination and subsequent Appointment of Mr. Charles Dadu Karisa as the County Executive Member in charge of Lands, Energy , Housing, Physical planning and Urban Development.

PRELIMINARIES
The meeting was called to order by the chairperson and opened with a word of prayer by Hon. Pascal Thuva at 2.25 p.m.
ADOPTION OF THE AGENDA
The Agenda was adopted as follows;
- Adoption of the Agenda.
- Vetting of the County Executive Committee Member in charge of ICT, Culture and Social Services.
- Any other business.
MINUTE 01/2016: VETTING OF THE NOMINEE FOR THE POSITION OF COUNTY EXECUTIVE COMMITTEE MEMBER IN CHARGE OF ICT, CULTURE AND SOCIAL SERVICES; MR. JOSEPH ELVIS TINGA JANGA
The chairperson welcomed the nominee to the approval hearing and requested him to furnish the Committee with his original documents. Thereafter, the nominee, honourable members and the secretariat were briefed by the chair on the vetting process procedure and the legal provisions guiding the same.
The nominee made the following submissions to the committee:-
- That, he was born in 1955 in Ruruma ward and was married with children.
- That, he went through Sacred Heart High school for O level and Kenyatta High Mwatate for A level respectively. Then, proceeded to the University of Nairobi for his undergraduate studies in Meteorology and to the university of Dar-salaam for his Master’s degree in Water Engineering.
- That, he was currently an Assistant Lecturer at Technical University of Mombasa water section in the Department of Civil Engineering.
- That, the docket involved modern use of technology in communication and centres where cultural activities took place. Also, the docket was more of policy making than a professional job.
- That, the nominee mentioned two cultural sites which were Gongoni Cultural Center and Mwanjama Cultural Center and he would strengthen the existing cultural centres and open new cultural centres.
- That, he was charged and acquitted from allegations of siphoning money from one of the bank accounts of Kenya Marine and Fisheries Institute as a signatory.
Finally, he appreciated the committee for its friendliness and requested the committee to approve him for the portfolio.

PRELIMINARIES
The meeting was called to order by the chairperson and opened with a word of prayer by the Principal Clerk at 10.30 a.m. The chairperson then introduced members of the committee and the secretariat.
ADOPTION OF THE AGENDA
The Agenda was adopted as follows;
- Adoption of the Agenda.
- Vetting of the County Executive Committee Member in charge of Lands, Energy, Housing, Physical Planning and Urban Development.
- Any other business.
MINUTE 03/2016: VETTING OF THE NOMINEE FOR THE POSITION OF COUNTY EXECUTIVE COMMITTEE MEMBER IN CHARGE OF LANDS, ENERGY, HOUSING, PHYSICAL PLANNING AND URBAN DEVELOPMENT; MR. CHARLES DADU KARISA
The nominee, honorable members, public and the secretariat were briefed by the chair on the vetting process procedure and the importance of public participation in the same. The nominee was further informed on the memoranda received from the Kilifi County Alliance and the Kilifi Nairobi Professionals Association.
The nominee, Mr. Charles Dadu Karisa made the following submissions to the committee:-
- That, according to the Constitution of Kenya Article 183 and County Government Act Section 36 respectively clearly stipulates the roles of the County Executive Committee Member as hereunder:-
- Policy making and proposing legislation
- Coordinating and supervision programs
- Update the county assembly through quarterly reports
- Planning and coordination of the entire county department
- Aligning county programs with national government policies and legislation
- That, he had the requisite experience and qualifications since he was a professional architecture with a master’s degree in planning. Additionally, he had worked as an Environmental Manager, a NEMA expert and a Trainer of planners at the University of Nairobi.
- That, the nominee would sensitize the people of Kilifi County on the Community Land Act and initiate structures that would help in handling land issues. Again, the nominee submitted that he will ensure there be proper record keeping and tracking so as to track land issues.
- That, he would find out about the status of land owned by absentee landlords and engage them if at all their leaseholds had expired. However, all this would be possible if land records are well documented. He also informed members that he would fast track the approval of the existing plans.
- That, to enhance clean production of energy, the nominee would check the existence of energy structures, identify energy sites, map out the energy value chains and empower the community so that they would coexist peaceful with the energy resources being exploited.
- That, the nominee was ready to take the job since he had completed his bonding period since 2005.
- That, he considered himself to be conversant with public service management since he was working with the University of Nairobi contrary to the view of the Kilifi County Alliance memorandum.
- That, in his capacity it will be challenging since there will be distraction as 2017 is approaching and it’s the election year. Furthermore, the tenure was almost coming to an end.
- That, he was not interested in politics because he thought he could not make one.
- That, the only way to aid as a CECM in charge in the Vipingo and Centum land question was to do land mapping and make land allegations factual since there were other institutions involved in the same.
- That, Athi River factory was not using the current sophisticated technology as compared to other plants in the world in the same industry.
Finally, the nominee appreciated the warm reception by the honorable members and the staff. In conclusion, the chairperson informed the nominee that he would communicate to him once the report was done and debated on the house for adoption through the Clerk of the County Assembly.

MINUTE 04/2016: ADOPTION OF THE REPORT OF COMMITTEE ON APPOINTMENT ON THE VETTING OF NOMINEES FOR THE POSITION OF COUNTY EXECUTIVE COMMITTEE MEMBERS IN CHARGE OF: I.C.T , CULTURE AND SOCIAL SERVICES ; LANDS, ENERGY, HOUSING, PHYSICAL PLANNING AND URBAN DEVELOPMENT; AND TRADE INDUSTRIALIZATION, COOPERATIVE DEVELOPMENT, TOURISM AND WILDLIFE
The Principal Clerk took through the honourable members the contents of the committee report as compiled by the Committee at Mombasa Beach Hotel on Friday 28th October, 2016. Thereafter, honourable members were informed that the nominee for the position of County Executive Committee Member in charge of Trade, Industrialization, Cooperative Development, Tourism and Wildlife; Ms. Zeyanna Abdullah had withdrawn from the vetting process.
However, the other two remaining nominees had turned up for the vetting/approval hearing. The Committee was informed that the Report had recommended that Mr. Joseph Elvis Tinga Janga, the nominee to I.C.T, Culture and Social Services be rejected while Mr. Charles Dadu Karisa, the nominee to Lands, Energy, Housing, Physical Planning and Urban Development be approved.
After deliberations, the committee unanimously adopted the committee report without any amendments.
